When is visitation awarded to a grandparent?
There are a number of circumstances that can lead to a grandparent being awarded visitation rights, but the court will always prioritize what’s in the best interest of the child. You must show a judge that your absence in your grandchild’s life would disrupt his or her emotional wellbeing.
Before awarding visitation rights, the court will consider the following factors:
- The quality of relationship between the child and the grandparent
- The mental and physical health of the child
- The child’s preference, if he or she is old enough to express it
- The mental and physical health of the grandparent
